What changes do we expect in immigration with the Biden-Harris administration?

We are waiting patiently as the United States of America's presidential elections become official now that a transition has begun per President Trump's tweet. We expect some changes with the new administration. We point out the places where we hope to see these changes in immigration law and its application.

 

We are waiting with anticipation to see who will be the next person to serve as Attorney General, head of the Department of Justice. This person has a key role in determining the application and implementation of existing and new laws such as Asylum laws and Temporary Protection Status (TPS).

 

Speaking of TPS - for Venezuelans, we expect a new administration to act on the many declarations by US government officials acknowledging the current catastrophe in Venezuela.

 

We expect the upcoming administration to stop the current efforts to restrict immigration by requiring immigrants to declare lawful use of government benefits, the Public Charge Rule.

 

We also expect the prevailing wage regulation, which results in an average increase of approximately 40% on wages required to be paid to H-1B workers and green card applicants.

 

We also hope that the new administration will not continue attacking the DACA program. On the contrary, we expect it to be maintained and expanded for new students who came to the country when they were young.

 

Finally, we also hope the new administration ceases the executive orders to ban travel and increase prohibitions that affect legal travel and immigration.
